By accessing or using our website at buildfirst.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age. If you are under 18, you may not use the Service.
Build First Apps provides a web-based tool that helps users design and plan AI applications using the POP-IT Framework (Problem, Output, Prompt, Inputs, Test). The Service includes:
The Service does not require user registration or account creation. We generate a random session identifier stored in your browser's local storage to maintain your progress through the wizard. This identifier is not linked to any personal information.
When you use our Service, you may provide:
This information is processed by AI services to generate suggestions and prompts. We store this data in our database for analytics purposes and to improve the Service.
We use the data you submit to improve the Service. This includes analyzing the problems, outputs, and prompts submitted by users to better understand how people use the tool and to enhance the quality of AI-generated suggestions. By using the Service, you consent to this use of your submitted data for product improvement purposes.

Both Anthropic and OpenAI state in their API terms that they do not use data submitted via API for training their models. However, we encourage you to review their respective privacy policies for complete information.
You may optionally share your build brief to our community library by checking the "Share my Build Brief (anonymously)" checkbox. This is entirely voluntary.
Build briefs shared to the library are publicly visible to all users of the Service. Do not share any confidential, proprietary, or sensitive information in build briefs you submit to the library.
Once submitted to the library, build briefs cannot be deleted by users. We reserve the right to hide or remove content that violates these Terms. If you need content removed, please contact us at the email address below.
By submitting a build brief to the library, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and make available your submission to other users of the Service.
You agree not to use the Service to:
You retain ownership of the content you create using the Service. The AI-generated suggestions and prompts are provided for your use, and you may use them for any lawful purpose.
The Service, including its design, features, and documentation, is owned by Create Connections LLC and protected by intellectual property laws. You may not copy, modify, or distribute our Service without permission.
The AI-generated suggestions, prompts, and recommendations provided by the Service are for informational and planning purposes only. We do not guarantee that:
You are solely responsible for reviewing, modifying, and implementing any suggestions provided by the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATE CONNECTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS (WHICH IS ZERO FOR FREE USERS).
We strive to keep the Service available but do not guarantee uptime. The Service depends on third-party AI providers (Anthropic, OpenAI) which may experience outages, rate limits, or service disruptions beyond our control. We may modify, suspend, or discontinue any part of the Service at any time without notice.
Your use of the Service is also governed by our approach to data handling described in Section 4 above. Key points:

We reserve the right to terminate or suspend your access to the Service at any time, for any reason, without notice. Upon termination, your right to use the Service will immediately cease.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and Create Connections LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, rather than in court, except that either party may bring claims in small claims court if they qualify.
The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association ("AAA"). The arbitration shall take place in New York, NY, or may be conducted remotely if agreed upon by both parties. The arbitrator's decision shall be final and binding.
Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and the Company individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
